luxembourgticket acts as a simple sales intermediary between the customer (hereinafter "you") and the organisers of the performances or events concerned, with the agreement of the various organisers. luxembourgticket manages the performances and events offered according to the instructions of the responsible organiser and also handles the issuing of tickets. The acquisition of the ticket establishes a contractual relationship for the event between you and the organiser in question.
These general terms and conditions concern only the ticketing sales transactions and in no way the performance or the event itself. At the event or performance, the general terms and conditions of the organiser concerned apply. These general terms and conditions may vary depending on the organiser and the venue of the event or performance.
1. TICKET PRICES AND PAYMENT
Ticket prices are indicated in euros, all taxes included, excluding participation in service and shipping costs.
All orders, regardless of their origin, are payable only in euros.
luxembourgticket reserves the right to modify its prices at any time, but tickets will be invoiced on the basis of the rates in force at the time the order is registered.
2. AVAILABILITY
All your reservations are made in real time on ticketing servers with allocation of our best available seats. In this context, our server informs you in real time about the availability of tickets at the time your order is placed, depending on the category chosen. In case of unavailability in one of the requested seat categories, our server automatically offers you the best remaining seats in the other categories.
When you make your reservation, the "basket" page allows you to verify that the seats assigned to you correspond to your wishes. Indeed, if the number of seats desired exceeds the number of seats remaining in the chosen category, it is possible that, taking into account first and foremost the number of seats requested, you may be assigned non-contiguous seats. If these seats do not suit you, you have the option to cancel them by clicking on the "delete position" button.
3. VENUE MAP AND SEAT LOCATION
During your reservation, your seats may be shown to you on a venue map if one is available and if they are numbered seats.
4. PAYMENT
We remind you that validating your order by clicking on the "buy now" button implies an obligation on your part to pay the indicated price including service and shipping costs, which may vary depending on the event.
You can pay for your purchases on our website by credit card, PayPal or by gift voucher.
5. SECURING PAYMENTS AND PERSONAL DATA
Our website is subject to a security system. For the transmission, processing and recording of data, we use modern and reliable technologies. Credit card payments are made through the TELECASH system during the online transaction, and the transmission of your data takes place in encrypted and secure form (https://...).
We collect only the following personal data: your name, postal address, email address and telephone number. Data processing is carried out in strict compliance with the applicable legal provisions and in particular the General Data Protection Regulation (Regulation (EU) 2016/679) (hereinafter "GDPR"). The legal basis and purpose of the processing of personal data are the execution of your order and the management of our business relationships. The following persons are recipients of the personal data and may access this data: the staff of Luxembourgticket GIE within the strict framework of the tasks entrusted to them. The data collected will be kept for a period not exceeding that necessary for the achievement of the purposes for which they were collected, without prejudice to the right of luxembourgticket to keep certain data for a longer period due to legal / regulatory obligations applicable to luxembourgticket, or due to exceptional situations that would justify longer retention (legal proceedings, etc.). You are informed that within the framework of the processing purposes carried out by luxembourgticket in accordance with paragraph 3 of point 5.2., the personal data may be transferred to other data controllers, to the organisers of the events for the needs of their commercial management. luxembourgticket will carry out such transfers in strict compliance with the GDPR. You agree that your personal data may be used for information and commercial prospecting purposes. You may freely and free of charge withdraw your consent or object at any time to the processing of your personal data by sending us a request as described in the last paragraph of this article. You also have, free of charge, a right of access and rectification concerning the personal data relating to you. You benefit from the right to be forgotten and may request the erasure of personal data, provided that legal constraints and obligations do not oppose this. In specific cases set out in the GDPR, you may also request the restriction of processing so that the personal data may, except for storage, only be processed with your consent. In specific cases set out in the GDPR, you have the right to receive all the personal data concerning you and provided to luxembourgticket and to transmit them to another data controller (right to data portability). luxembourgticket reserves the right to charge fees for such a transfer, in the case of frequent requests and / or in the case of a request deemed excessive in terms of the volume of data concerned. You must inform luxembourgticket in writing in good time before the end of the processing as described in paragraph 3 of point 5.2. if you intend to exercise this right. Otherwise, luxembourgticket cannot be held responsible for the deletion of personal data. Without prejudice to any other administrative or judicial remedy, you have the right to lodge a complaint with the Commission nationale pour la protection des données if you consider yourself to be a victim of a violation in the processing of your personal data. 6. VALIDATION
You declare that you have read and accepted these general terms and conditions of sale before placing your order. The validation of your order constitutes unreserved acceptance of these general terms and conditions.
7. OBTAINING TICKETS
Depending on the case, you have the choice for obtaining your tickets between:
Delivery by post: Sending tickets by post entails payment of postage costs by you, which are indicated to you at the time of the order.
Collection from one of our points of sale: When you place your order, collection from one of our points of sale may be offered to you. In this case, you can, from the end of your order, present yourself at one of the collection points mentioned on the website or at the event box office, with your reservation number, an identity document and the bank card used to pay for your order.
Ticketdirect (print@home): If you choose this collection method, we send you the ticket by email in PDF format, which you must print yourself. This ticket is personalised and includes your name and address. The PDF format is a special file format intended for displaying documents. To print the ticket, you need the Adobe Acrobat Reader DC © program. We recommend that you print the ticket immediately and then save the file using the Acrobat Reader program on your hard drive so that you can reprint it if necessary. If you have provided a valid email address, the ticket will also be sent to you by email (in PDF format).
Ticketdirect-Mobile: By choosing this collection method, we make the ticket available to you in the form of a QR code that you will receive by email. Please keep in mind that a Ticketdirect may require the presentation of a valid identity document to be accepted at the entrance of the event. The provision of the Ticketdirect may entail the payment of specific fees, which are indicated to you at the time of the order.
8. EXCHANGE AND RETURN OF TICKETS
In accordance with Article L.122-9(7)l) of the Consumer Code, performance tickets are not subject to a right of withdrawal.
A ticket cannot be refunded even in case of loss or theft, nor taken back, nor exchanged, except in the case of cancellation of the event concerned. luxembourgticket reserves the right to accept the return of tickets in certain cases and at its sole discretion.
In case of cancellation or postponement of an event, we inform you immediately by email, post or telephone. In case of cancellation, the organiser of the event defines the refund procedures, and our liability cannot be called into question. If we are responsible for the refund, we carry it out as quickly as possible (as soon as we receive payment from the organiser). In case of postponement of an event, we will inform you whether the organiser grants the right of return and, if so, within what period they wish to exercise the right of return.
In case of cancellation of the event, only the ticket price will be refunded to you. No costs of any kind will be refunded or compensated.
9. CUSTOMER SERVICE AND ORDER TRACKING
We provide you with a customer service that you can reach according to the procedures set out on our website www.luxembourgticket.lu.
10. APPLICABLE LAW – DISPUTES
The ticketing sales referred to in these terms are subject to Luxembourg law.
In case of dispute, the Luxembourg courts are solely competent.
